fictitious action : In English, an action brought for the sole purpose of obtaining the opinion of the court on a point of law, not for the settlement of any actual controversy between the parties. A typical example of this action in the Iranian law would be a petition to a court for issuing a judicial declaration of hereditary succession (ie گواهي انحصار وراثت ). In its more usual sense in Iran, however, it is said of any make-believe quarrel or action between two persons with their collusive agreement for some gain, legitimate or illegitimate
